PRIVACY NOTICE ON THE SELECTION AND RECRUITMENT 

 

Through this Privacy Notice we would like to provide you with details about the processing of your personal data in the context of our selection and recruitment process.

We recommend that you read this Privacy Notice together with the Privacy Policy, in order to obtain as much information as possible on how we protect your personal data.

WHAT IS THE SOURCE OF YOUR PERSONAL DATA?

We may obtain your personal data from several sources:

Directly from you, when:

  • You apply for one of the positions available on online recruitment platforms; (e.g. E-jobs, best jobs, etc.);
  • You contact us or send us your CV directly to us by email at recrutare@therme.ro, using the contact form on the website or by other electronic means;
  • You submit your resume, in physical format, to one of our offices.

Indirectly, when:

  • Your resume is public on the online recruitment platforms (E-jobs, best jobs etc.);
  • Your resume is sent to us by another person, as a recommendation;
  • Your resume is available at job fairs;
  • Your resume is obtained through externam recruitment and selection providers.

WHAT ARE THE CATEGORIES OF DATA THAT WE PROCESS?

In the selection and recruitment process we process the following categories of personal data:

  • Data found in your resume which may contain: identification and contact details, image, data on education and professional activity, skills, competences, hobbies, previous jobs, as well as any relevant data you provide;
  • Recommendations, which we may ask from your current/former employers;
  • Date resulting from interviews you hold with the recruitment team/management team;
  • Where necessary, data resulting from proficiency tests;
  • Where applicable, data collected automatically for security purposes when you appear for the interview. For example, data collected by video surveillance systems in our locations, in appropriately signposted areas.

WHY DO WE PROCESS THIS DATA?

The processing of personal data is necessary in order to carry out our personal selection and recruitment activity for vacancies.

WHAT ARE THE LEGAL GROUNDS ON WHICH WE PROCESS YOUR DATA?

The data processing for the mentioned purposes is carried out on the basis of our legitimate interest in finding suitable candidates for vacancies, to schedule and conduct interviews, to communicate the decision or for any activity necessary in the selection and recruitment process.

The retention of data post-interview, if you have not been selected, is also based on our legitimate interest, when we believe that your profile fits for other positions that our company is going to make available.

If you would like to object to data processing, please contact us at dataprotection@therme.ro. Upon your request, we will cease processing and delete your personal data. As a result, we will no longer be able to use your data for the aforementioned processing purposes and activities and any previously established meetings will be canceled.

WHO ELSE HAS ACCESS TO YOUR PERSONAL DATA?

Your data can also be accessed by our service providers, who help us in the performance of our operational activities, such as: IT service providers, selection and recruitment providers, security service providers, application and web tools providers, etc.

Personal data is accessed by third parties only to the extent that this is reasonably necessary,in accordance with the purposes mentioned in this information Note.

HOW DO WE MANAGE INTERNATIONAL DATA TRANSFER?

As a rule, your personal data is processed in Romania, within Europe Union and countries that provide an adequate level of protection, as required by the General Data Protection Regulation no 679/2016.

However, the use of it systems may also involve the transmission of data outside the European Union and countries that do not provide an adequate level of protection, such as the United States. HOW LONG DO WE KEEP YOU PERSONAL DATA?

As a rule, we keep your personal data in our database throughout the recruitment process.

If you have been rejected, when we believe that your profile fits for other vacant positions that we will make available to candidates, we will keep your resume for a longer period, up to 3 months. If you do not wish to do so, you can ask us to delete the data at any time.

If you are accepted, your resume is kept in the personnel file and archived for a period of 75 years, in accordance with the Decision no. 905/2017 on the general register of employees and the Law on national Archives no. 16/1996, Annex 6.

We periodically evaluate storage periods to ensure that we retain your data only for as long as necessary in relation to the purposes pursued.

AUTOMATED DECISION MAKING PROCESSES

In our processing activities we do not use automated decision-making or profiling that may produce legal effects that concern you or that may similarly affect you to a significant extent. In making decisions, the human factor is always involved.

To the extent that it will be necessary to adopt exclusively automated processes, we will ensure that we protect your rights and freedoms and that we comply with all legal data protection requirements.

  • Right to be informed;
  • Right of access;
  • Right to rectification;
  • Right to erasure, under the conditions stipulated by law;

  • Right to object to the processing of your personal data;
  • Right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects on you or similarly affects you to a significant extent, with the exceptions set out in data protection laws;
  • Right to lodge a complaint with a supervisory authority.

The information presented in this Privacy notice will be reviewed periodically to reflect any changes in current processing activities.

However, if we intend to significantly change the way we use your personal data, we will notify you in advance.
